Definitions:

- “Buyer” or “Customer”: the consumer who has placed an order for a product sold on the Website;

ARTICLE 1. ABOUT US
1.1 – Scope
These General Terms and Conditions of Sale (GTC) apply to the e-commerce website www.delicatus.be owned by m’enfin SCS (hereinafter referred to as the “Seller”, “Delicatus Boutique” or “Delicatus”), registered with the Banque-Carrefour des Entreprises (BCE) under the VAT BE0670.669.282, whose registered office is located at Rue du Moulin Maisin 2, 1370 Jodoigne, BELGIUM.
By using this Website, the Customer acknowledges that they have read and accepted these terms and conditions.
Resale of any products purchased on this website, whether partially or in full, is strictly prohibited.
1.2 – Purpose
These Terms and Conditions of Sale define the contractual relationship between Delicatus Boutique and the Buyer (hereinafter referred to as the “Customer”) and the conditions applicable to any purchase made through the website www.delicatus.be.
The purchase of a product through this Website implies the Buyer’s unreserved acceptance of these GTC, which the Buyer acknowledges having read prior to placing an order.
Before any transaction, the Buyer declares that: (i) the purchase of products on the website www.delicatus.be is unrelated to their professional activity and is limited to strictly personal use; and (ii) they have full legal capacity to enter into these GTC.
1.3 – Modification
Delicatus Boutique reserves the right to modify these General Terms and Conditions of Sale at any time, in order to comply with applicable law or to improve the use of its Website. The applicable terms and conditions will be those in effect on the date of the order by the Buyer and upon their publication on the website www.delicatus.be.
Any modification of these GTC will be communicated by email to the address provided by the Customer during registration or when placing an order. This email will contain a summary of the changes and a link to the updated version of the GTC on our Website.
It is the Customer’s responsibility to keep their email address up to date in their Customer Account. Delicatus Boutique will not be held liable for non-receipt of the notification email due to an incorrect or outdated email address.
ARTICLE 2. PRODUCTS
2.1 – Products Offered
The products offered for sale are those listed on the Website, subject to availability.
Delicatus Boutique reserves the right to modify its product assortment at any time.
Each product is presented on the Website with a description outlining its main technical characteristics (liquid measure, usage instructions, composition). The product descriptions provided on this Website are for informational purposes only and are intended to provide a general overview of the product. While Delicatus strive for accuracy and completeness, we do not guarantee that the descriptions are exhaustive or free from errors. Slight variations in product specifications, ingredients, or packaging may occur – please refer to the product label for the most accurate information.
The sale of products presented on www.delicatus.be is intended for Buyers residing in countries that fully authorize the entry of these products into their territory.
By placing an order, the Customer acknowledges that they have reviewed the product description and characteristics. The Client’s purchase is subject to all applicable legal provisions regarding consumer rights and product warranties.
2.2 – Product Colors
Product photographs are for illustrative purposes only. While Delicatus makes every effort to accurately represent the appearance of the products, actual colors and textures may vary slightly due to differences in screen settings, lighting, and other factors. The images should not be relied upon as a perfect representation of the product’s appearance.
Delicatus Boutique guarantees that the products conform to the Customer’s order and meet the reasonable expectations they may have, considering the product specifications. The Seller guarantees, of course, that the products comply with all applicable laws at the time of the order.
2.3 – Availability
Product availability is always displayed on the Website as an indication. Any unavailability is, in principle, noted on the Website.
However, if Delicatus Boutique cannot obtain a product within a reasonable timeframe (for example, in case of out-of-stock), the Customer will be notified of the expected delay by email. If the stock is insufficient to fulfill the order due to a supply issue, the Customer will be informed and offered an alternative product or a voucher.
The voucher will be issued for the value of the unavailable item and will be valid for six months from the date of issue. It can be used on any product on the website www.delicatus.be, and can be combinable with other promotions unless otherwise stated. The voucher is non-refundable.
ARTICLE 3. ONLINE SALE CONCLUSION
3.1 – Contract Formation
The Customer places an order by following these steps:
- Creating a Customer Account or logging in to an existing account.
- Selecting the desired products and adding them to the shopping cart.
The Customer can modify the contents of their cart at any time. - Validating the shopping cart after verifying its contents.
- Entering or verifying delivery information.
- On the order summary page, expressly accepting the Terms and Conditions of Sale.
- Redirection to the secure payment platform to finalize the payment.
The Customer’s final acceptance of the order occurs upon payment validation by entering their banking details (card number, expiry date, and CVV). Placing an order implies the Customer’s full and unreserved acceptance of these GTC.
3.2 – Order Placement Process
Once the order has been submitted, the Customer will receive a confirmation email containing their order details, including the list of items ordered, personal information, delivery address, and shipping method.
Cash on delivery and money order payments are not accepted.
For security reasons, Delicatus Boutique reserves the right to request additional information from the Customer via email to the address provided during the order process. If no adequate response is received, if the information provided is deemed insufficient, or if Delicatus Boutique suspects an intention to resell the products, the order may be cancelled. The Customer will be notified of any cancellation by email.
3.3 – Data Accuracy
The Buyer is responsible for the accuracy of all information provided during the order process.
Delicatus Boutique cannot be held liable for errors made by the Buyer in entering the recipient’s details (delivery address, billing address, etc.) or for any delivery delays or inability to deliver the products ordered resulting from such errors. Automated recording systems serve as proof of the nature, content, and date of the order.
ARTICLE 4. PAYMENT TERMS
4.1 – Prices
Prices are displayed in euros (€) and include all taxes (VAT), excluding shipping costs.
Delivery costs are the responsibility of the Customer unless otherwise stated on the Website (for example, during promotional offers). These costs are calculated based on the delivery address provided by the Customer.

Delicatus Boutique reserves the right to modify its prices at any time. However, the price applicable to the order is the one in effect at the time of order confirmation.
4.2 – Secure Payment
Online payments are processed by our payment partner Mollie, which guarantees secure transactions. Mollie’s privacy policy is available here: https://www.mollie.com/en/privacy.
The payment details and card information of the Customer will solely for processing the order and will never be shared with third parties.
Various payment methods are available during the checkout process. If the Buyer chooses to pay by online banking or credit card, the amount will be immediately debited from their account.
Delicatus Boutique aims to process the order within 2-3 business days after payment confirmation. This timeframe may be exceptionally extended during periods of high activity (sales, holidays, etc.) or due to unforeseen circumstances (public holidays, severe weather, etc.). In such cases, the Customer will be notified by email.
ARTICLE 5. DELIVERY
5.1 – Delivery Times
Products purchased on www.delicatus.be are only delivered to the countries listed on the Website.
After order preparation, Delicatus Boutique commits to shipping the ordered products to the delivery address provided by the Customer within a timeframe generally between 3 and 5 business days for Belgium, Luxembourg, Netherlands, Germany and France.
This delivery time is provided for informational purposes only. They depend, in particular, on the availability of carriers. Delicatus Boutique cannot be held responsible for exceptional circumstances that may impact the delivery process (strikes, delays, weather, etc.).
5.2 – Delivery Methods
Orders placed on the Website can be delivered in various ways – they can be shipped to an existing postal address via the carrier and delivery method chosen by the Customer during the ordering process.
For delivery to a different address, the Customer must pay the standard delivery charges, also indicated during the ordering process. Delicatus Boutique is not responsible for any customs fees and other taxes, duties, or additional charges that third parties may apply after shipment.
If a package is not received despite multiple delivery attempts by the carrier, it will be returned to Delicatus Boutique, and the recipient will be notified. The package will be carefully stored until the Buyer contacts the Customer Service either via the contact form available on the Website or the email address orders@delicatus.be. An additional delivery can be requested by the Buyer, who will bear the costs (even if the first shipment was free).
5.3 – Delivery Issues
Upon receiving the package, the Customer must verify the conformity and condition of their order. In case of any discrepancies (missing product, damaged package, etc.), the Customer must immediately report detailed reservations to the carrier and inform Delicatus Boutique within 48 hours of receipt (by email at orders@delicatus.be or via the contact form), specifying their order number.
Goods are shipped at the Customer’s risk. It is their responsibility to refuse any package that is damaged or suspected of theft. If the damaged package returned to Delicatus Boutique is refused by the Customer, the order will be reshipped to the Customer free of charge.
In case of return to the sender due to non-collection at the post office or relay point:
Within 14 days of delivery:
The Customer will be fully refunded for the order amount. Return shipping costs remain the responsibility of the Customer. Note that this return will be considered a withdrawal, and the Customer must inform Delicatus Boutique of their decision to withdraw from the contract by an unambiguous statement (for example, a letter sent by post, email, or via the contact form on the Website).
Beyond 14 days of delivery:
The Customer will be refunded the order amount, minus return shipping costs and a €10 processing fee. This processing fee covers administrative and logistical costs related to the return.
5.4 – Transfer of Risk
The risk of loss or damage to products passes to the Customer upon delivery, meaning when the Customer (or a designated third party) physically take possession of the goods.
