Delivery Time and Shipping Costs

The Customer will be notified by email with the package tracking number once the order has been
dispatched.

Shipping costs are calculated automatically at the end of their order based on the delivery location.

Right of Withdrawal

In accordance with the European Directive 2011/83/EU, the Buyer has a period of 14 calendar days from the delivery of their order to exercise their right of withdrawal and return the product for a refund without penalty, except for the return costs which will be borne by the Buyer.

The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and indicated by the Customer, acquires physical possession of the last good.

To exercise the right of withdrawal, the Customer must notify Delicatus Boutique of their decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or e-mail to orders@delicatus.be), before sending the package at their expense.

Refund Policy

If the Customer has already received their order

If the Customer exercises their right of withdrawal, Delicatus Boutique will reimburse all payments received from the Customer, including the costs of standard delivery without undue delay and in any event not later than 14 days from the day on which we are informed of their decision to withdraw from this contract.

Delicatus will carry out such reimbursement using the same means of payment as the Customer used for the initial transaction, unless they have expressly agreed otherwise; in any event, they will not incur any fees as a result of such reimbursement. The reimbursement may be withheld until we have received the goods back or the Customer has supplied evidence of having sent back the goods, whichever is the earliest.

The Customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. They have the right to examine the product as they would in a shop. However, using the product beyond what is strictly necessary for this examination may result in a diminished value. If Delicatus Boutique finds such a diminished value, we reserve the right to deduct a corresponding amount from the reimbursed sum.  This amount will be calculated on a case-by-case basis, depending on the condition of the returned product and its residual market value.

Original shipping costs are non-refundable for partial returns or for orders that could not be delivered due to an incorrect address provided by the Customer.

If the order has not been dispatched yet

Upon exercising the right of withdrawal, Delicatus Boutique will reimburse all payments received from the Customer without undue delay and in any event not later than 14 days following their request.

Returns Involving Promotional Offers and Gifts

Promotional Offers

If the Customer has benefited from a promotional offer (e.g., a discount, free shipping) that was conditional on purchasing a certain number of items or spending a certain amount, and they later return part of the order, the refund will be adjusted if the return means the original conditions for the offer are no longer met.
Specifically, the value of the promotional benefit you received will be deducted from your refund amount.

Free Gifts

If the Customer received a free gift as part of a promotion, they must also return the gift if they are returning the product(s) that qualified for it. The gift must be returned in its original, unused condition. If the Customer fails to return the gift, or chooses to keep it, its value will be deducted from the refund.

Governing Law and Dispute Resolution

This contract is governed by Belgian law.

In the event of a dispute, Delicatus Boutique prioritizes an amicable resolution. To this end, we invite the Buyer to contact us at hello@delicatus.be to attempt to find a solution. In accordance with EU regulations, you can also use the European Commission’s Online Dispute Resolution (ODR) platform to resolve any disputes. The platform is accessible here: http://ec.europa.eu/odr.

If an amicable agreement cannot be reached, any dispute relating to the interpretation or execution of this contract shall be subject to the exclusive jurisdiction of the courts of the judicial district of Walloon Brabant. However, this does not affect your statutory rights to bring a claim in your country of residence if you are a consumer.

Evidence and Miscellaneous Provisions

The parties (the Seller and the Buyer) agree to accept electronic means of proof, such as emails and records from computer systems. A printed version of the General Terms and Conditions of Sale, and of any notice given in electronic form, shall be admissible as evidence in any judicial or administrative proceedings.

If one or more provisions of the General Terms and Conditions of Sale are held to be invalid or declared as such pursuant to a law, regulation, or a final decision of a competent court, the remaining provisions shall retain their full force and scope. The invalid provision will be replaced by a valid and lawful provision that most closely approximates the spirit and purpose of the original provision.
